Lechner’s quite apparent nervousness might well have been explained because, after he had spoken only a few sentences, Justice Antonin Scalia brusquely asked: “You’re not reading this?” Lechner didn’t answer, simply standing silent for a lengthy embarrassed moment.
Well, one assumes that a victory in the case, released today, makes him feel better.
Anderson (and every other legal blogger on the internet) blogged about the oral argument uncharacteristically taking Scalia’s side, and I noted that perhaps the statute prohibiting oration at the Supreme Court court had something to do with it.
