**UPDATE: Matthew Kinne has been indicted for capital murder
The attorney representing the family of slain Dominique “Lucy” Clayton told news reporters Friday that he believes former police officer Matthew Kinne has been indicted by a grand jury in her death.
However, the District’s Attorney’s Office hasn’t confirmed the indictment.
Attorney Carlos Moore, with The Cochran Firm-MS Delta, said prosecutors met with Clayton’s mother and step-father on Friday morning.
“She is under the impression that an indictment has been reached; however, they did not tell her what the indictment exactly is. We don’t know whether it was for capital murder, first-degree murder or manslaughter. But we do believe there has been an indictment.”
Clayton was found shot to death in her home on May 20. Two days later, Kinne, a patrol officer with the Oxford Police Department at the time, was arrested and charged with her murder.
Kinne is being held on no bond at the Union County Jail.
Police and family said the two were in a relationship despite Kinne being married. He was with OPD for four years before being terminated after his arrest.
The grand jury finished up Thursday. After the grand jury hands down an indictment, an affidavit is issued which is then filed with the Circuit Court Clerk. Cases are sealed until the person indicted is served and the record returned to the court.
Moore said the District Attorney’s Office will call the Clayton family next week and let them know what the grand jury decided.
He also said he plans on filing a civil lawsuit against the city of Oxford and the Oxford Police Department possibly next week.
If convicted, Kinne could face the death penalty.
